Consumer Privacy
Protections Notice

  1. Does this notice apply to you?

    1. Most of our users’ privacy protections flow from contracts, education law, and/or health care law. Some of our United States-based users have privacy rights that arise under their state’s “consumer data privacy” law(s). These users are (1) natural persons—not businesses, and (2) interacting with us in a “personal context”: typically, parents or grandparents who purchase for use with their children or grandchildren. These are our “Consumer” users.

    2. This notice applies if you are a Consumer and live in a state with a Consumer data privacy law that applies to small businesses.

  2. What consumers need to know.

    1. This notice adds to our Boom App General Privacy Notice. It does not repeat items covered in that notice.

    2. We do not sell consumer personal information, and we do not share that information for advertising purposes without your consent.

    3. Information you provide to us when interacting with us on our information and social sites or with our customer service, sales and marketing teams is covered in our Information Site Privacy Policy.

    4. Our information website pages recognize and honor Global Privacy Control (GPC) signals as a valid opt-out mechanism for third-party cookie-based data collection. Learn more about Global Privacy Control signals.

  3. Managing sensitive personal information.

    1. Some information that we collect in the Boom App or to set up a subscription may be considered Sensitive Personal Information. We use the information you provide to the extent needed:

      1. for the operation of our services and the Boom Store,

      2. to enter into and perform an agreement with you,

      3. to comply with legal and regulatory requirements, and

      4. as otherwise permissible for our own internal legitimate purposes consistent with applicable law and our data minimization policies.

    2. If you use the Colleagues feature to “share” information about your child’s performance with another adult user, that user will see all your child’s information. Do not use the Colleagues feature unless you are okay with sharing all of your student’s performance information.

    3. We do not use profiling for automated decisions. If we introduce automated decision making in the future, we will provide notice of that decision making and an opportunity to opt out.

  4. Exercising your rights-additional rights for consumers.

    1. If you contacted us to exercise your rights and are not happy with the results, you can appeal. We will provide a written statement of our decision.

    2. You may contact your state Attorney General if you are not satisfied with the outcome.

  5. We don't profile Boom App users.

    1. We use the information we gather to deliver the Boom App.

    2. When creating your account on the Boom App, we ask users to opt-in to allow Google Analytics to create usage analytics and help us improve our products. You may prevent analytics tracking by not opting-in or by adjusting your cookie preferences. If you opt in to usage analytics, we take steps to limit identifying information that is provided to Google Analytics.

    3. All advertising participation is opt-in. See our Information Site Privacy Policy.
